These Terms and Conditions govern your access to and use of the Autos.Africa website, mobile services, seller dashboard and related services collectively referred to as the “Platform.”

The Platform is operated by Hawk Express Technologies (Private) Limited, trading as Autos.Africa, referred to in these Terms as “Autos.Africa,” “we,” “us” or “our.”

By accessing the Platform, creating an account, submitting a vehicle listing, purchasing advertising or contacting a seller through the Platform, you agree to these Terms and Conditions.

You should not use the Platform if you do not accept these Terms.

2. About Autos.Africa

Autos.Africa is an online automotive advertising and marketplace platform that connects vehicle buyers, private sellers, dealerships, importers and other automotive businesses across Africa.

Autos.Africa provides a platform through which sellers may advertise vehicles and buyers may contact sellers directly.

Unless expressly stated otherwise, Autos.Africa:

  • does not own the vehicles advertised;
  • does not act as the seller, buyer, dealer, broker or agent in a vehicle transaction;
  • does not collect payments or deposits on behalf of sellers;
  • does not inspect, test, value, certify, finance, insure, transport or deliver vehicles;
  • is not a party to agreements made between buyers and sellers; and
  • does not guarantee that a transaction will be completed.

Any contract for the purchase or sale of a vehicle is made directly between the buyer and the seller.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, advertise a vehicle or purchase services through Autos.Africa.

Where you use the Platform on behalf of a company, dealership or other organisation, you confirm that you have authority to accept these Terms on its behalf.

4. User accounts

Some Platform features require you to create an account.

You agree to:

  • provide accurate, complete and current registration information;
  • keep your username, password and login details secure;
  • notify us promptly if you suspect unauthorised access;
  • ensure that information displayed on your seller profile remains accurate; and
  • accept responsibility for activity carried out through your account.

You must not create an account using false information, impersonate another person or use another person’s account without permission.

We may require reasonable verification of your identity, business, dealership or authority to advertise a vehicle.

We may refuse, suspend or close an account where we reasonably believe that these Terms have been breached or that the account presents a risk to users or the Platform.

5. Vehicle listings

Sellers are responsible for ensuring that every listing is accurate, lawful and not misleading.

A vehicle listing should clearly state, where applicable:

  • vehicle make and model;
  • year of manufacture;
  • mileage;
  • transmission and fuel type;
  • condition;
  • location;
  • price and applicable currency;
  • import or registration status;
  • known faults or material damage;
  • whether the vehicle has previously been written off or seriously damaged;
  • whether finance, ownership restrictions or other third-party interests exist; and
  • whether taxes, customs charges, registration fees or delivery costs are included.

A seller must have legal authority to advertise and sell the vehicle.

Listings must not contain:

  • false or misleading descriptions;
  • inaccurate mileage information;
  • stolen or unlawfully obtained vehicles;
  • vehicles that the seller has no authority to sell;
  • copied photographs used without permission;
  • false prices intended only to attract enquiries;
  • unlawful, discriminatory or offensive content;
  • contact details belonging to another person without permission;
  • malicious links, software or code; or
  • information that infringes another person’s rights.

Sellers must promptly update or remove a listing when the vehicle is sold, withdrawn or no longer available.

6. Photographs and listing content

Photographs must show the vehicle being advertised and should provide a fair representation of its condition.

By uploading photographs, descriptions, videos, logos or other content, you confirm that:

  • you own the content or have permission to use it;
  • the content does not infringe intellectual property, privacy or other legal rights;
  • individuals visible in the content have given any necessary permission; and
  • the content complies with applicable laws.

You grant Autos.Africa a non-exclusive, worldwide, royalty-free licence to store, reproduce, resize, display, distribute and promote the content for operating and marketing the Platform.

This licence continues while the relevant listing or account remains active and for a reasonable period afterwards for backups, legal compliance and record-keeping.

7. Listing review and removal

We may review, edit, reject, suspend or remove a listing where:

  • it breaches these Terms;
  • it appears fraudulent, misleading or unlawful;
  • information cannot be reasonably verified;
  • we receive a credible complaint;
  • required fees have not been paid;
  • it creates a security or reputational risk;
  • the vehicle has already been sold; or
  • removal is required by law or a competent authority.

Review or approval of a listing does not mean that Autos.Africa has inspected, verified or endorsed the vehicle or seller.

We are not required to provide advance notice before removing content where immediate action is reasonably necessary.

8. Seller responsibilities

Sellers must:

  • respond honestly and professionally to enquiries;
  • disclose material information about the vehicle;
  • allow buyers a reasonable opportunity to inspect the vehicle;
  • comply with applicable consumer, motor-trade, tax, customs and registration laws;
  • issue receipts or contractual documents where legally required;
  • protect personal information received from buyers;
  • honour any promises or warranties they provide; and
  • avoid requesting payment through suspicious or untraceable methods.

Dealerships and commercial sellers are responsible for holding any licences, permits or registrations required for their operations.

9. Buyer responsibilities

Buyers are responsible for making their own enquiries before purchasing a vehicle.

Before making payment, buyers should consider:

  • viewing and inspecting the vehicle;
  • arranging an independent mechanical inspection;
  • confirming the seller’s identity and authority to sell;
  • checking registration and ownership documents;
  • checking the vehicle identification and chassis numbers;
  • checking whether finance or third-party interests exist;
  • verifying mileage, service history and accident history;
  • confirming customs, import and tax status;
  • obtaining a written sale agreement and receipt; and
  • using a secure and traceable payment method.

A listing, seller profile or communication through Autos.Africa should not be treated as a guarantee that a vehicle or seller is genuine.

Buyers should not send money solely because a seller claims there are other interested buyers, requests urgent payment or refuses reasonable verification.

10. Prices and currencies

Vehicle prices are entered by sellers and may be displayed in different currencies.

The advertised price may not include:

  • taxes;
  • customs duties;
  • registration charges;
  • finance costs;
  • insurance;
  • delivery or transportation costs;
  • inspection fees; or
  • other transaction expenses.

Buyers and sellers must confirm the final price, currency, payment arrangements and included costs directly with each other.

Any currency conversions displayed by Autos.Africa are estimates and may differ from the exchange rate applied by a bank, payment provider or seller.

11. Listing subscriptions and advertising fees

Autos.Africa may charge fees for:

  • vehicle listings;
  • dealership or seller accounts;
  • featured or sponsored listings;
  • homepage or category advertising;
  • banner advertising;
  • promotional campaigns; and
  • other premium services.

The price, duration and features of each service will be displayed or agreed before purchase.

Unless otherwise agreed in writing:

  • fees must be paid in advance;
  • advertising begins after payment and approval;
  • unused advertising time cannot be transferred;
  • fees are non-refundable after the service has started, except where required by law;
  • suspension caused by the advertiser’s breach does not entitle the advertiser to a refund; and
  • applicable bank, transfer, currency-conversion or transaction charges are the customer’s responsibility.

Autos.Africa may change its prices by giving reasonable notice. Price changes will not normally affect a service period that has already been paid for.

12. Free trials and promotional offers

Autos.Africa may offer free trials or promotional periods to eligible sellers.

Free trials:

  • are available for the stated period only;
  • may be limited to certain accounts, locations or listing quantities;
  • cannot normally be exchanged for cash;
  • may not be repeatedly claimed using multiple accounts;
  • may be withdrawn where misuse is suspected; and
  • do not guarantee continued free access after the trial ends.

When a trial expires, listings may be suspended, removed or restricted unless the seller selects and pays for an available plan.

13. Banner and third-party advertising

Advertisers are responsible for ensuring that their banners, promotions, landing pages and claims are accurate and lawful.

Autos.Africa may reject or remove an advertisement that is misleading, unlawful, offensive, technically harmful or unsuitable for the Platform.

The appearance of an advertisement does not mean that Autos.Africa endorses the advertiser, product or service.

Users should independently assess third-party advertisers before entering into transactions with them.

14. Enquiries and communications

The Platform may enable buyers to contact sellers through telephone, email, enquiry forms, WhatsApp or other communication channels.

When you submit an enquiry, relevant contact details and enquiry information may be shared with the seller so that the seller can respond.

Autos.Africa does not guarantee that:

  • a seller will respond;
  • contact information will remain current;
  • an enquiry will result in a sale; or
  • communications between users will be accurate or lawful.

Users must not use enquiry facilities to send spam, threats, abusive messages, malicious links or unrelated commercial promotions.

15. Prohibited use

You must not use Autos.Africa to:

  • commit or facilitate fraud;
  • advertise stolen, cloned or unlawfully obtained vehicles;
  • manipulate odometer or vehicle-history information;
  • impersonate another person or business;
  • collect personal information without a lawful reason;
  • send unsolicited bulk communications;
  • interfere with the Platform’s security or operation;
  • introduce viruses, malware or harmful code;
  • scrape, copy or extract listings at scale without written permission;
  • create competing databases using Platform content;
  • bypass access restrictions or payment requirements;
  • misuse seller or buyer contact details;
  • publish defamatory, threatening, discriminatory or unlawful content; or
  • violate applicable laws or third-party rights.

We may report suspected criminal or fraudulent activity to relevant authorities and preserve information where legally permitted or required.

16. Fraud and safety

Although Autos.Africa may use moderation, technical controls and account checks, no online marketplace can eliminate every risk.

Autos.Africa does not guarantee the identity, honesty, creditworthiness or conduct of any user.

Users should report suspicious listings, payment requests, messages or accounts through [support email or reporting link].

We may investigate reports, request supporting evidence, restrict accounts or remove listings. We are not required to disclose confidential details of an investigation or action taken against another user.

17. Intellectual property

The Autos.Africa name, logo, website design, software, databases, graphics and original content are owned by or licensed to Autos.Africa.

You may use the Platform for personal or authorised business purposes only.

You must not reproduce, distribute, sell, modify, reverse engineer or commercially exploit Platform content without prior written permission, except where permitted by law.

Vehicle manufacturers’ names and trademarks belong to their respective owners. Their use in listings is for identifying vehicles and does not imply endorsement or affiliation.

18. Privacy and cookies

Personal information collected through the Platform will be handled in accordance with our Privacy Policy and applicable data-protection laws.

Our Privacy Policy should explain:

  • what information we collect;
  • why it is collected;
  • how it is used and shared;
  • how long it is retained;
  • the use of cookies and analytics;
  • the rights available to users; and
  • how users may contact us about personal information.

You should read the Privacy Policy together with these Terms.

19. Third-party links and services

The Platform may contain links to third-party websites, payment providers, finance companies, insurers, messaging services, mapping tools or social-media platforms.

Autos.Africa does not control these services and is not responsible for their availability, security, content, privacy practices or contractual terms.

Your use of a third-party service is governed by that provider’s own terms and policies.

20. Availability of the Platform

We aim to keep Autos.Africa available and functioning properly, but we do not guarantee uninterrupted or error-free access.

Access may be affected by:

  • maintenance;
  • upgrades;
  • hosting or internet failures;
  • security incidents;
  • events outside our reasonable control;
  • changes to third-party services; or
  • legal or regulatory requirements.

We may add, remove or change features without notice where reasonably necessary.

21. Disclaimer of warranties

To the extent permitted by law, the Platform is provided on an “as available” basis.

Autos.Africa does not guarantee:

  • the accuracy or completeness of listings;
  • the condition, quality, safety or legality of a vehicle;
  • the identity or authority of a seller;
  • that a buyer has sufficient funds;
  • that a listed vehicle remains available;
  • that a stated price will be accepted;
  • that information supplied by users is genuine;
  • that a transaction will be completed; or
  • that the Platform will always be free from errors or harmful components.

Users rely on listings and communicate or transact with other users at their own discretion.

22. Limitation of liability

To the maximum extent permitted by law, Autos.Africa will not be liable for losses arising from:

  • a transaction or failed transaction between users;
  • inaccurate or misleading listing information;
  • vehicle defects, accidents or mechanical failures;
  • stolen or fraudulently advertised vehicles;
  • payments or deposits made to sellers;
  • loss of profit, revenue, opportunity, data or goodwill;
  • unauthorised access to a user account caused by the user’s failure to secure login details;
  • third-party websites or services;
  • temporary Platform unavailability; or
  • conduct by buyers, sellers, advertisers or other third parties.

Where Autos.Africa is legally liable and the liability may lawfully be limited, its total liability relating to a paid service will not exceed the amount paid by the affected user for that service during the six months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability, rights or remedies that cannot lawfully be excluded or limited.

23. Indemnity

To the extent permitted by law, you agree to compensate Autos.Africa for reasonable losses, claims, costs or expenses resulting from:

  • your breach of these Terms;
  • unlawful or misleading content submitted by you;
  • your infringement of another person’s rights;
  • your misuse of personal information; or
  • a claim relating to a vehicle or service you advertised or supplied.

This clause does not apply where the loss was caused by Autos.Africa’s own unlawful conduct.

24. Suspension and termination

You may stop using the Platform at any time.

We may suspend, restrict or terminate access where:

  • you breach these Terms;
  • payment is overdue;
  • fraud or unlawful conduct is suspected;
  • your activity risks harming users or the Platform;
  • information required for verification is not supplied;
  • we are required to act by law or an authority; or
  • continued access creates a security or reputational risk.

Termination does not remove obligations or liabilities that arose before the termination date.

Provisions relating to intellectual property, liability, indemnity, disputes and other clauses intended to survive termination will continue to apply.

25. Complaints

Please include:

  • your name and contact details;
  • the relevant listing or account;
  • a clear description of the issue;
  • supporting documents or screenshots; and
  • the outcome you are requesting.

We will consider complaints within a reasonable period. Complaints about a vehicle or transaction should normally be raised directly with the seller first, as Autos.Africa is not the seller.

26. Changes to these Terms

We may update these Terms to reflect changes to the Platform, business practices, security requirements or applicable laws.

The updated version will be published on the Platform with a revised “Last updated” date.

Where changes materially affect registered users, we may provide additional notice through email, an account notification or another reasonable method.

Continued use of the Platform after updated Terms become effective constitutes acceptance of those Terms.
